The Council of the Municipality of Lakeshore passed By-law 85-2023 on October 10, 2023, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended. This By-law amends the Municipality of Lakeshore Zoning By-law 2-2012, as amended.
The applicant listed above (Municipality of Lakeshore) applied for these amendments according to subsection 34(18) of the Planning Act, R.S.O. 1990,c.P.13, as amended, which indicates that notice shall be given to any prescribed person or public body who has the right to appeal this by-law. If you choose not to appeal this by-law, no further action is necessary.
Purpose and Effect:
The purpose of this Zoning By-law amendment is to add the definition of ‘Short-Term Rental Accommodation’ and add general policies that prohibit Short Term Rental Accommodations within the Municipality of Lakeshore but continue to permit Bed and Breakfast establishments.
Appeal Process:
Only individuals, corporations or public bodies may appeal a by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

The Notice of Appeal must be filed no later than 20 days from the date of this Notice and shall include:
- The reasons for the appeal.
- A completed OLT Appeal Form (A1) Appellant Form. This form is to be completed by the appellant for appeals relating to Zoning By-Laws and amendments and is available on the Ontario Land Tribunal website.
- A fee in the amount of $400.00 (fee for a private citizen, a registered charity or a non-profit ratepayers’ association) or $1,100.00 (Corporate Fee), pursuant to the Ontario Land Tribunal Act, 2021, S.O. 2021, payable by certified cheque or money order to the “Minister of Finance”.
The last day for filing a Notice of Appeal is 4:30 p.m. on November 14, 2023.
