Notice of the Passing of a Zoning By-law Amendment by the Municipality of Lakeshore
Take Notice that the Council of the Municipality of Lakeshore has passed By-law 92-2024 and By-law 16-2025on the 4th day of February 2025, under Section 34 of the Planning Act, R.S.O. 1990.
Take Notice that an appeal to the Ontario Land Tribunal in respect to this Zoning By-law Amendment may be completed by filing a notice of appeal with the Clerk of the Municipality of Lakeshore no later than the27thof February, 2025,a notice of appeal setting out the objection to the By-law and the reasons in support of the objection, accompanied by the required fee, as per the Ontario Land Tribunal website, made payable to the Minister of Finance. Upon receipt, the letter of appeal, a copy of the appeal form, which is available from the Ontario Land Tribunal website at www.olt.gov.on.ca, and other documents from the application file will be forwarded to Ontario Land Tribunal.
Take Notice No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
Please Note notwithstanding the above, subsection 34(19) of the Planning Act identifies the eligible ‘persons’ that may appeal the decision to the Ontario Land Tribunal.
An Explanation of the purpose of the by-law, describing the lands to which the by-law applies, and a key map showing the location of the lands to which the by-law applies, are detailed below. The complete By-law and any associated information are available for inspection at Town Hall during regular office hours.
Explanatory Note
By-law 13-2025affects the 35 dotted hatched semi-detached lots and 5 hatched single-detached lots in the Key Map provided. The by-law rezones the parcels to “Residential – Medium Density Zone Exception 26 (R2-26)” to permit a reduced minimum exterior side yard setback of 3.5m and an increased lot coverage of 40% for the hatched semi-detached and single-detached lots.
