Notice of the Passing of a Zoning By-law Amendment by the Municipality of Lakeshore
Take Notice that the Council of the Municipality of Lakeshore has passed By-law 15-2025on the 4thday of February 2025, under Section 34 of the Planning Act, R.S.O. 1990.
Take Notice that an appeal to the Ontario Land Tribunal in respect to this Zoning By-law Amendment may be completed by filing a notice of appeal with the Clerk of the Municipality of Lakeshore no later than the6thof March, 2025, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection, accompanied by the required fee, as per the Ontario Land Tribunal website, made payable to the Minister of Finance. Upon receipt, the letter of appeal, a copy of the appeal form, which is available from the Ontario Land Tribunal website at www.olt.gov.on.ca, and other documents from the application file will be forwarded to Ontario Land Tribunal.
Take Notice No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
Please Note notwithstanding the above, subsection 34(19) of the Planning Act identifies the eligible ‘persons’ that may appeal the decision to the Ontario Land Tribunal.
An Explanation of the purpose of the by-law, describing the by-law which applies, to the whole Municipality is described below. The complete By-law and any associated information is available for inspection at Town Hall during regular office hours.
EXPLANATORY NOTE
By-law 15-2025affects all lands within the Municipality and therefore no key map has been provided. The Municipality initiated this housekeeping amendment to its comprehensive Zoning By-law 2-2012 to adopt regulation to better clarify terms, meaning and intent, and to remove inconsistencies in an effort to improve interpretation.
The amended definitions include “building”, “dormer”, “floor area, gross”, “open space, landscaped”, and “waste area enclosure”. Further amendments include changes to Section 6.29, Section 6.46, and 8.6. Other minor amendments provide clarity to terms and remove inconsistencies. The complete by-law is available for review upon request. All other provisions still apply of Lakeshore Zoning By-law 2-2012.
