Purpose of Meeting: The Municipality of Lakeshore is proposing amendments to the Lakeshore Comprehensive Zoning By-law 2-2012 that will improve the functionality of the By-law as it pertains to specific definitions and uses.
Definitions: The proposed amendment includes incorporating definitions for ‘Additional Residential Unit’, ‘Boarding, Lodging and Rooming House’, ‘Library’, and ‘Privacy Screen as these definitions to not currently exist. Refinements to the definitions of ‘Dwelling, Converted’, and ‘Dwelling, TwoUnit’ are also proposed in order to bring terminology into conformity with regulations in the Zoning By-law.
Uses: The proposed amendment includes permitting Apartment Buildings in the ‘Residential – High Density (R3),’ ‘Central Area (CA)’ and ‘Mixed Use (MU)’ Zones. Apartment Dwellings are currently permitted but not Apartment Buildings. This amendment will provide clarity that the intent is to permit Apartment Dwellings in Apartment Buildings and will not result in increased development permissions. Additionally, in conformity with the Municipality’s Official Plan, the proposed amendment will permit Office Use in the ‘General Employment (M1)’ zone. The proposed amendment also includes: limiting the application of artificial turf in required landscaping areas; permitting encroachments for air conditioning units, heat pumps and generators in the front yard when related to an additional residential unit; and permitting a 0.0 meter side yard setback for retaining walls. Council will consider an amendment to Lakeshore Zoning By-law 2-2012, as amended (File: ZBA-08-2024), under Section 34, of the Planning Act, R.S.O.1990, c.P.13.

Right to Appeal: If a person or public body would otherwise have an ability to appeal the decision of the Municipality of Lakeshore to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
