Purpose of Meeting:
The Municipality of Lakeshore has initiated a housekeeping amendment to its comprehensive
Zoning By-law 2-2012 to adopt regulations for Additional Residential Units. The purpose of the amendment is to bring the Zoning By-law into conformity with the Planning Act as amended by Bill 23, the More Homes Built Faster Act, 2022. No key map is provided as the proposed amendment applies to all lands in Lakeshore.
The proposed amendment includes the addition of a definition for “garden suite”, as well as a definition for “additional residential units” which will replace existing definitions for “converted dwelling” and “secondary dwelling unit”. The amendment permits additional residential units (ARUs) on lands zoned low- and medium-density residential, waterfront residential, hamlet residential, mixed use, urban reserve, and agriculture (R1, R2, RW1, RW2, HR, CA, MU, UR, and A).
In accordance with Subsection 34 (35.1) of the Planning Act, the amendment will permit up to three dwelling units per lot on urban residential lands, and up to two dwelling units per lot in the Agriculture (A) zone. Where permitted, ARUs may be associated with a single detached, semi-detached, or townhouse dwelling, and may be located in the main dwelling or in an accessory building.
The proposed amendment includes regulations restricting the size and height of ARUs, as well as requirements for setbacks, entrances, and water and sanitary servicing.
Take notice that Council will consider an amendment (File: ZBA-13-2024) to Lakeshore Zoning By-law 2-2012, as amended, under Section 34 of the Planning Act, R.S.O.1990, c.P.13.

Right to Appeal:
If a person or public body would otherwise have an ability to appeal the decision of the Municipality of Lakeshore to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the Municipal Clerk of the Municipality of Lakeshore before the proposed Zoning By-law Amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
